EyePhotography · Podpera GmbH AGB / Terms · AT-2026-10-06 1. Provider and scope Podpera GmbH, Hauptstraße 2, 2232 Deutsch-Wagram, Austria; FN 645298v, Landesgericht Korneuburg; UID ATU81836989. E-Mail: office@eye-photography.at; Telefon: +43 2247 57028. These terms apply to consumer contracts for EyePhotography iris artwork, related digital files and gift vouchers on www.eye-photography.at and at Austrian partner locations where agreed before the contract is concluded. Equipment, business purchases and partner compensation are governed by separate agreements. 2. Partners, orders and contracts Podpera GmbH is the seller of the EyePhotography products offered here. Partners take photographs and record order details; any independent partner services must be identified separately. The product, design, size, total price, delivery and payment method are shown or agreed before a binding order. You can check and correct your details first. Completing an order using a button clearly indicating an obligation to pay constitutes a binding offer. An automated acknowledgement is not acceptance; the contract is concluded by our express acceptance or commencement of the agreed performance. Contract information is provided by email. These terms can be downloaded and printed. The contract language is German or English when ordering in English. 3. Prices and payment Total prices shown before ordering include statutory VAT. Shipping and agreed extras are disclosed separately before ordering. Available payment methods are displayed in the checkout. A bank transfer or banking QR payment is considered paid only once receipt of funds has been confirmed; scanning a QR code is not payment confirmation. Where offered, electronic payments are processed through Stripe. The payment deadline is stated on the invoice. A reminder may be sent for unpaid amounts. No flat reminder fees arise without express agreement. 4. Design, approval and usage rights We manually edit your iris photographs for the ordered artwork. Any preview allows you to check the design, names and order of irises; please request changes before production approval. Approval does not remove statutory defect claims. Minor technical differences between screen display and print may occur; substantial deviations are not agreed as compliant on that basis. Purchased digital files may be used and printed privately. Commercial use requires separate agreement. Only provide images you are entitled to use. Advertising use of your photographs is not part of the purchase and requires separate permission. 5. Delivery and digital files Physical products are delivered to the agreed customer address or partner location. Printed gift vouchers are currently shipped within Austria only. A different delivery period must be expressly agreed before conclusion; otherwise delivery takes place within 30 days of conclusion. Please respond promptly when design approval is needed; any necessary delivery-date change will be agreed with you. Digital files are supplied in the agreed format via protected download or email. Internet access and software to open that format are required. Shipping risk passes only upon delivery to you or your nominated third party other than the carrier. 6. Gift vouchers and promotions Gift vouchers become redeemable once payment is confirmed. Unused credit remains available. We do not agree a shortened expiry period for newly purchased gift vouchers; statutory limitation rules remain applicable. Delivery as a PDF or inclusion of a recipient name does not automatically exclude withdrawal rights. Discounts are subject to the conditions published before purchase. A second-artwork code applies only to a physical reorder according to that code’s conditions; a digital-only purchase does not create such entitlement. Newsletter subscriptions are optional and not required for a regular purchase. Unsubscribing does not affect completed purchases. 7. Withdrawal from distance contracts Consumer contracts concluded online or exclusively at a distance generally carry a statutory 14-day withdrawal right. For goods the period begins on receipt; for digital content and voucher contracts it generally begins on contract conclusion. Non-prefabricated goods made to your individual choice or clearly personalised are exempt under section 18(1)(3) FAGG. This covers physical artwork made from your iris photographs; statutory warranty rights remain unaffected. We do not rely on personalisation alone to exclude withdrawal for digital files. Without the separate consent and acknowledgement legally required for early performance, withdrawal rights for digital content remain intact. Full instructions and a model form are available under Withdrawal. Contracts concluded solely in a shop generally do not carry the statutory distance-contract withdrawal right. 8. Statutory warranty and complaints Statutory warranty rights, particularly under the VGG and ABGB, apply without restriction by these terms. Report defects to office@eye-photography.at or your partner. Failure to inspect or report immediately does not remove statutory rights. We will arrange necessary steps with you and bear the legally required costs. A change in taste after compliant production is not itself a product defect. 9. Liability Statutory liability rules apply. Liability for personal injury, intent or gross negligence and mandatory consumer rights are not excluded. 10. Privacy and communications Processing of contact, image, order, payment and delivery data is described in our privacy notice. Acknowledging this information is not consent to advertising. Newsletters and promotional voucher reminders require separate voluntary consent. Necessary contract, invoice and payment communications are independent of that consent. 11. Governing law and complaints Austrian law applies without removing mandatory protection of your country of habitual residence or statutory court jurisdiction. No exclusive business court is imposed on consumers. Please send complaints to the contact address above. We do not undertake to participate voluntarily in alternative dispute resolution; statutory information duties in a dispute remain unaffected. 12. Version Version: 6 October 2026 · AT-2026-10-06. The version agreed before conclusion applies. Later changes do not apply retroactively to existing contracts.
